Students charged with assault withdraw from university

Two New Mexico State University students arrested as suspects last week in an on-campus assault of another student have withdrawn from the university, according to Interim Vice President for Student Services Juan N. Franco.

R. Short, 18, of Carlsbad, N.M., and Phillip Austin Lanier, 18, also of Carlsbad, formally withdrew this morning, Franco said.

A third suspect in the case turned himself in to university police at 3:40 p.m. today. Kirk D. Westfall, 20, is being charged with battery and false imprisonment as a result of the incident that occurred in a residence hall at 12:40 a.m. Aug. 26. Westfall is not a New Mexico State student.

Franco said the student judicial investigation process, which began immediately after the incident, will continue even though the students are no longer enrolled. The purpose of this administrative investigation is to determine whether there has been a violation of the student code of conduct.
